Periodic Review of Rules

Periodic Rules Review - Notification of Determination

As required at least once every 10 years in compliance with G.S. 150B-21.3A(c )(1), the Board of Examiners for Engineers and Surveyors (the “Board”) has conducted an analysis of each existing rule. The Board has made an initial determination as to whether the rule is (i) necessary with substantial public interest, (ii) necessary without substantial public interest, or (iii) unnecessary. The initial determination is found here for Chapter 56. The public is invited to comment on the rules and the Board’s initial determination during the public comment period.

The public comment period begins September 27, 2018 and ends November 26, 2018. “Public Comment” is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule. Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).

Identifying the rule, please email comments to David Tuttle at NCBELSRulesComments@ncbels.org or to his attention at the Board office by US Postal Service or other delivery service.
